Introduction

The NAMM Foundation (the “Foundation”) promotes and supports music education and music making for people of all ages and abilities. This Privacy Notice describes the Foundation’s policies and practices regarding its collection, use and sharing of personal information.

How we collect personal information

We collect information that you give us through our website, mobile apps, over the phone and through other correspondence.  For such manually submitted information, you generally decide how much information to share with us, but not providing certain information may prevent us from fulfilling your request or otherwise performing the purpose for which the information is collected. 

We may obtain information about you from other sources.  For example, the National Association of Music Merchants (“NAMM”) as well as organizations we partner with may provide us your contact information based on, for example, your attendance at their events. 

We collect information automatically.  By visiting and interacting with our website and mobile apps, we collect certain technical data by automated means such as your IP address, browser type and version, operating system, and analytic information about your activity on the website or app. In most cases, this information is collected through web server logs or through the use of cookies and related technologies. Types of personal information we collect and how we use it

The Foundation collects personal information about our donors, vendors and others with whom we interact. This typically includes contact information such as first name, last name, address, email, and phone number, information about your donations and other interactions with the Foundation, and other information as further described in this notice. We use this information to promote and otherwise operate our organization, including providing information about the Foundation’s various programs and activities, and for such other uses as described in this notice.

Payment card information:

You may choose to make donations to the Foundation using a payment card. Typically, payment card information is provided directly by users, via the Foundation’s website. The Foundation may retain certain payment and billing information except that the credit card number itself is stored by the Foundation’s third-party credit card processor, not by the Foundation, and may be retained for purposes of processing of recurring or future donations you may choose to make.

Ways we may use your personal information:

We use your personal information for the following purposes.

  • To promote and operate our organization and its various programs and to solicit and process the donations that fund them;

  • To identify, connect with and provide information to donors, prospective donors and those who participate in the programs we provide or fund;

  • To administer, protect, operate, and maintain our website, systems and networks;

  • To customize, measure, and improve our website and services;

  • To analyze and develop new programs and websites and improve existing ones;

  • To perform accounting, auditing, billing, reconciliation, collection, and similar administrative activities;

  • To prevent, detect, identify, investigate, respond to, and protect against potential or actual claims, liabilities, prohibited behavior, and criminal activity;

  • To comply with and enforce applicable legal requirements, agreements, and policies; and

  • To perform other activities consistent with this notice.

Cookies

Cookies are small files that are stored on your device when you visit a website. We use cookies to do a number of things such as remember preferences, help process online donations, allow you to subscribe to our newsletters, and analyze your web page visits and activity to help us improve our programs based on your inferred interests. Cookies do not themselves store information that identifies you, but they are often used in a manner that they can be associated with you.

Here are the types of cookies you will encounter in using our website:

  • Strictly Necessary - these are required by our website to perform certain functions such as allowing you to donate through our website;

  • Functional – these help to improve your experience by doing things like remembering donations you've added to your shopping cart or remembering certain preferences you have set; and

  • Analytic – these are used to analyze, in an aggregated manner, the way our website is used so that we can improve the website and our offerings. We use Google Analytics for this purpose.

Note that links on our website and mobile apps may lead you to third party sites that operate under different privacy practices. When and how we share information with others

Where applicable, we share personal information in the follow ways:

  • with NAMM;

  • with our partners, suppliers or agents for the purpose of assisting us in delivering or fulfilling the programs, surveys, newsletters and other activities in which we engage or to otherwise provide services to us;

  • with fraud-prevention, credit references, and business and credit scoring agencies;

  • with debt collection agencies or other debt-recovery organizations;

  • with law enforcement agencies, government bodies, regulatory organizations, courts or other public authorities if we have to, or are authorized to by law;

  • to satisfy any applicable law, or other legal or regulatory requirement;

  • with a third-party with which we are engaged in an acquisition, merger, asset sale, or other similar business transfer that involves substantially all of our assets where personal information is transferred or shared as part of the business assets.

International transfers of personal information

The Foundation has its headquarters in the United States and information we collect from you in other countries will be transferred to and processed in the United States, although certain of our service providers may then access the information from outside the United States. We endeavor to apply suitable safeguards to protect the privacy and security of your personal information consistent with the practices described in this Privacy Notice.

Your Choices

You may avoid our collection and use of manually submitted personal information by not providing it to us, although this may prevent us from providing services you request. 

You may unsubscribe from our email marketing communications or newsletters by following the instructions or unsubscribe mechanism in the e-mail message or by contacting us at the contact information provided below. Note, if you choose to opt out of such communications, we may still communicate with you regarding non-marketing transactional or administrative related purposes.

To the extent provided by the law of your jurisdiction, you may have the right to access or correct the personal information we maintain about you and, in some cases, you may require that we delete the information, or object to or request that we restrict our processing of the information. Security of your information

We maintain reasonable and appropriate security measures to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

Data Retention

We will retain your personal information for the period necessary to fulfill the purposes outlined in this notice unless a longer retention period is required or permitted by law, for legal, tax or regulatory reasons, or other legitimate and lawful business purposes.  

Changes to the Privacy Notice

We reserve the right to change, modify, add or remove portions of this notice from time to time and in our sole discretion, but will alert you that changes have been made by indicating on this notice the date it was last updated. When you visit our website, or provide us your personal information under circumstances covered by this notice, you are accepting the current version of this notice as posted at that time. We recommend that you revisit this notice on occasion to learn of any changes.
